OVERVIEW

Welcome to BareForge. The terms “we,” “us,” and “our” refer to Bare Forge LLC, doing business as BareForge.

BareForge operates this website and online store, including the information, content, features, products, tools, and services made available through it (collectively, the “Services”). Our ecommerce infrastructure and checkout services are powered in part by Shopify.

These Terms of Service (the “Terms”), together with any policies referenced in them, govern your access to and use of the Services.

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

SECTION 1 — ELIGIBILITY AND ACCOUNT INFORMATION

By using the Services, you represent that you are at least the age of majority in your state or jurisdiction of residence, or that you have permission from a parent or legal guardian where required.

When using the Services, you may be asked to provide information including your name, email address, billing information, payment method, and shipping address. You agree to provide information that is accurate, current, and complete.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

We aim to describe and display BareForge products accurately. However, packaging, colors, product appearance, and other visual details may vary slightly from what appears on your device.

Product descriptions, formulations, pricing, availability, and other information may be updated from time to time.

We reserve the right to discontinue products, modify product offerings, or limit quantities available for purchase, subject to applicable law.

Information provided through BareForge is for general educational and informational purposes and is not intended to diagnose, treat, cure, or prevent any disease or replace professional medical advice.

SECTION 3 — ORDERS

Submitting an order constitutes an offer to purchase.

We reserve the right to accept, decline, limit, or cancel an order where reasonably necessary, including in cases involving suspected fraud, pricing errors, product availability, payment issues, or violations of these Terms.

An order is considered accepted when payment is successfully processed and confirmation is issued.

Please review your order carefully before submitting it. We will try to accommodate changes or cancellations requested before fulfillment begins, but we cannot guarantee that an order can be modified once it has entered processing.

Purchases are subject to our Shipping & Returns Policy.

BareForge products are intended for personal use unless otherwise agreed in writing.

SECTION 4 — PRICING, PAYMENT, AND TAXES

Prices and promotions may change from time to time. The price charged will be the price displayed at checkout when your order is submitted, subject to correction of obvious pricing or technical errors.

BareForge currently offers free standard shipping on U.S. orders. Other charges, taxes, or fees that apply to an order will be disclosed at checkout where required.

You represent that:

The payment information you provide is accurate and complete;
You are authorized to use the payment method provided; and
You authorize us and our payment providers to charge the amounts shown at checkout.

Applicable taxes will be collected where required by law.

SECTION 5 — SHIPPING AND DELIVERY

BareForge currently ships within the United States.

Orders are generally processed within 1–3 business days after payment is confirmed. Transit and delivery estimates are not guarantees and may be affected by carriers, weather, holidays, or other circumstances outside our reasonable control.

Tracking information will be provided after shipment when available.

Customers are responsible for providing an accurate and complete delivery address.

Questions involving delayed, missing, damaged, or incorrect orders are handled according to our Shipping & Returns Policy.

Risk of loss and ownership of purchased goods transfer in accordance with applicable law.

SECTION 6 — RETURNS AND REFUNDS

Eligible returns may be requested within 30 days of delivery.

Unless otherwise stated in our Refund Policy, products must be unopened, unused, and in their original packaging to qualify for a standard return.

Opened or used supplements cannot be returned for safety and hygiene reasons.

Damaged, defective, or incorrect orders should be reported within 7 days of delivery.

SECTION 7 — INTELLECTUAL PROPERTY

Unless otherwise stated, the BareForge name, logos, trademarks, product names, written content, graphics, photographs, videos, designs, software, and other original materials made available through the Services are owned by BareForge or used under license.

You may access and use the Services for personal, non-commercial purposes.

You may not reproduce, distribute, modify, publish, sell, commercially exploit, or create derivative works from protected BareForge content without prior written permission, except where permitted by law.

Third-party trademarks and intellectual property remain the property of their respective owners.

SECTION 8 — THIRD-PARTY SERVICES AND LINKS

The Services may incorporate or link to services operated by third parties, including ecommerce, payment, shipping, analytics, and other technology providers.

Your use of third-party services may also be governed by those providers’ terms and privacy policies.

BareForge is not responsible for the content, availability, security, or practices of third-party websites or services that we do not control.

SECTION 9 — SHOPIFY

BareForge uses Shopify technology to support portions of our ecommerce infrastructure, including checkout and related commerce functionality.

Purchases from BareForge are transactions between you and BareForge, except where applicable law or a specific Shopify service provides otherwise.

Shopify and its affiliates maintain their own terms, privacy practices, and legal responsibilities for the services they provide.

SECTION 10 — PRIVACY

Our collection, use, and disclosure of personal information are governed by our Privacy Policy.

Shopify and other service providers may also process personal information in connection with services they provide to BareForge, subject to their own legal obligations and privacy terms.

SECTION 11 — REVIEWS, FEEDBACK, AND SUBMISSIONS

If you voluntarily submit a review, suggestion, comment, testimonial, idea, or other feedback to BareForge, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, and adapt that material for legitimate business and promotional purposes, subject to applicable law.

You represent that you have the right to submit the material and that its use will not violate another person’s rights.

We may moderate or remove content submitted through our Services where appropriate.

SECTION 12 — ERRORS AND CORRECTIONS

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product information, availability, pricing, promotions, shipping, or other matters.

We may correct errors or update information when discovered.

Where an error materially affects an order already placed, we may contact you to correct the issue or cancel and refund the affected order where appropriate.

SECTION 13 — PROHIBITED USES

You may not use the Services:

For unlawful, fraudulent, or deceptive purposes;
To infringe intellectual property or other legal rights;
To transmit malware, malicious code, or harmful technology;
To interfere with the operation or security of the Services;
To impersonate another person or misrepresent your identity;
To scrape, harvest, or improperly collect information from the Services;
To harass, threaten, or harm others; or
In any other manner that violates applicable law.

We may restrict or terminate access to the Services for material violations of these Terms.

SECTION 14 — TERMINATION

We may suspend or terminate access to the Services where reasonably necessary, including for violations of these Terms, unlawful activity, fraud, security concerns, or abuse of the Services.

Termination does not eliminate obligations or rights that arose before termination.

Provisions that by their nature should survive termination will remain in effect.

SECTION 15 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

We do not guarantee that the website or Services will always operate without interruption, delay, error, or security issue.

Nothing in these Terms excludes warranties, protections, or other rights that cannot legally be excluded or limited.

SECTION 16 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, BareForge and its officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from or relating to use of the Services.

Nothing in these Terms limits liability where doing so would be prohibited by applicable law.

SECTION 17 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless BareForge and its affiliates from claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Services, material violation of these Terms, or infringement of the rights of another person.

SECTION 18 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

SECTION 19 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

These Terms and the policies incorporated by reference constitute the agreement governing your use of the Services, except where another written agreement expressly applies.

SECTION 20 — ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our written consent.

BareForge may assign its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or other lawful business transaction.

SECTION 21 — GOVERNING LAW

These Terms are governed by the laws applicable in the jurisdiction where Bare Forge LLC is headquartered, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

Nothing in this section deprives consumers of rights or protections that cannot lawfully be waived.

SECTION 22 — CHANGES TO THESE TERMS

We may update these Terms from time to time.

When material changes are made, the Last Updated date at the top of this page will be revised. Your continued use of the Services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
